GBG Independent Distributor (ID) / Customer Policies and Procedures
The GBG business has a number of terms and definitions associated with it, as well as policies and procedures that ID's must be aware of and abide by. Below are definitions of each.
Any individual, using his/her social security number or EIN, may apply to become a Member. An individual may not hold a full or partial interest in more than one GBG ID position. You must be eighteen years of age or older to be an ID.
Married couples can hold one position or they can each hold individual positions. If both names are on the Membership Application, then the Terms and Conditions shall bind both parties, as shall the information herein, regardless of the social security number or EIN utilized. It is always better to own and work just one position with GBG's unique pay plan.
Businesses, Corporations and Partnerships:
A Business, Corporation, or Partnership can become an ID; however, they must provide a social security number or an Employer Identification Number (EIN). The Terms and Conditions bind all corporate directors and officers, as shall the information in this New Member's Guide herein. The Business, Corporation, or Partnership is requested to appoint one individual as the party responsible for the Corporation's operations as an ID.
A sole proprietorship can become an ID and the Proprietor may use either his/her social security number or EIN number for identification purposes.
Social Security Numbers:
All ID's are required to use their social security number (or EIN, if a business) in order to be paid commissions. They will be given a ID Number that can be used in lieu of a social security number for identification in GBG's system. Individuals or partnerships joining GBG using a social security number may not hold interest in multiple positions by the use of utilizing a social security number and EIN.
Individuals, Businesses, Corporations and Partnerships can use an EIN number for identification purposes. They also will be given a ID Number that can be interchanged with the EIN number. Individuals, business corporations or partnerships joining GBG using an EIN may not hold interest in multiple positions by the use of multiple EINs.
A ID Number is an internally generated identification number linked to the ID's position. It can be used to identify the ID in place of the social security or EIN number.
Attempting to sell or promote another MLM opportunity to another GBG ID, whom you have not personally sponsored into GBG and is an unethical practice.
The unauthorized sending of mass emails is illegal and grounds for prosecution.
Any material transmitted via facsimile that advertises the commercial availability or quality of any property, goods, or services, which is transmitted to any person without that person's prior express invitation or permission.
Illegal Sponsoring Practices:
Unethical, illegal or immoral sponsoring practices will not be tolerated. Abridgment of Independent Distributor.
Violating any of the Terms and Conditions of the IR Membership Agreement or violating any of the Policies and Procedures are grounds for termination.
Misrepresentation of the GBG business opportunity, misleading, erroneous or deceptive statements, use of materials not approved by or provided by GBG or any other unethical behavior is grounds for immediate termination.
Infringement of Copyright, Patent and Trademark Restrictions:
Unauthorized use of The Companies name, logos, mottos, trademarks or unauthorized reproduction of any copyright or patented material is grounds for immediate termination.
Independent Distributor Membership Claims:
ID's must be at least 18 years of age and therefore of legal age in their state of occupancy. All ID's must also have an address.
Independent Distributors are responsible for any expenses incurred in the operation of their GBG business. ID's shall hold The Company harmless from any claims, damages or liabilities arising out of an ID's business practices.
In the event that one of the associated vendors should not pay commissions due, GBG nor any of its affiliates are obligated to pay these commissions to ID's. ID's shall hold GBG and any affiliates harmless from any loss of revenue resulting from an associated vendor failing to pay commissions due.
ID's are responsible for paying their own taxes – federal, state, local or any other taxes due from any regulatory agency. ID's earning more than $600.00 per year will be issued a 1099 at the end of the year for all income earned from any associated Company as required by law. Corporations or partnerships will not receive a 1099.
ID's can conduct business anywhere in the United States without franchise or territorial restrictions.
Cancellations and Refunds:
The Independent Distributor Application signed by all ID's states, "A participant in this Network Marketing plan has a right to cancel with no refund at any time, regardless of the reason." Additionally, on the back of the application, "You may cancel this transaction without penalty or obligation no later than midnight of the third business day subsequent to the day of this order. To cancel this order you must mail, wire, fax or deliver a signed and dated written notice to GBG at the address stated on this application." If a refund is issued, the Upline ID's that received Fast Start Pay will be charged back against future earned commissions for the Fast Start amount they were paid. The Upline ID is ultimately responsible to repay the company the Fast Start Pay received, at the company's request, for an ID who cancels and is issued a refund. GBG must do this because they are refunding money to the cancelled ID. Once an ID has cancelled his or her position, he or she must wait 90 days before re-applying for Membership. Any State laws or regulations at variance with these policies will take precedence over these conditions.
An ID can be terminated immediately, at the sole discretion of GBG, for any violation of the Terms and Conditions or Policies and Procedures, and will be informed of such decision in writing. The termination will be in effect from the date of notification by GBG. GBG's decision is final and not subject to further review. An ID can be terminated for any of the following reasons, inclusive of, but not limited to: Cross-Recruiting, Spamming, Fax Blasting, Illegal Sponsoring Practices, Abridgment of Independent Distributor Agreement, Use of Non-approved Marketing Literature, Unethical Behavior, Infringement of Copyright, Patent, and Trademark Restrictions, or Failure to Comply with Continuing Sales and Leadership Responsibilities as denoted in section 9 of the GBG Terms and Conditions. An ID will also be downgraded to a Gold Customer if the monthly auto ship requirement is not met for 2 consecutive months.
Transfer/Sale of Position:
One ID may sell or transfer his/her position to another party. The sale or transfer can take place at the sole discretion of GBG. Parties must complete a "Transfer of Sale of Position form" stating name and ID Number of transferring ID and name and social security or EIN number of new ID. The form must be signed by both parties and notarized. An Independent Distributor Application and Membership Agreement for the new ID must accompany the form. The transfer/sale will take place at the sole discretion of GBG. A transfer form may be acquired by calling the GBG call center.
Inheritance of Position:
An ID's position can be inherited. The party inheriting the position must send a copy of the death certificate and a notarized letter stating the previous ID's name and ID number and the new name and social security number for the position. An Independent Distributor Application and Membership Agreement for the new ID must accompany the letter.
Name Change/Change of Address:
ID's must notify GBG and Companies whose services they are utilizing in writing when a name or address change occurs. To notify GBG, send the information to GBG PO Box 2238, Vacaville, CA 95696 or fax to 707-453-4674. Make sure that you sign your correspondence. If a position is owned by more than one person (husband/wife, partnership or corporation), all parties must sign the letter.
Any checks returned for non-sufficient funds will be assessed a fee of $25.00.
Business Meetings are an option for current and prospective Members. The meetings assist in learning more about the GBG opportunity. The charge for Opportunity Meetings is not to exceed $5.00 for existing ID's and there is NO allowable charge for prospective ID's. For Training Meetings where a GBG ID is charging more than $5.00 admission, the meeting material and agenda must be approved by Corporate. It is the sole responsibility of the ID organizing a business meeting to comply with any additional state laws and/or requirements.
Advertising and Promotional Materials:
The GBG name, logos and trademarks, as well as those of any Recommended Companies, may only be used with written approval from GBG. Any approved use must indicate the Independent Distributor status. Advertising materials that do not mention GBG or its affiliates is the sole responsibility of the Independent Distributor.
